I was recently asked if CHL instructors can do the annual recertification required by retired law enforcement officers. I've heard conflicting opinions so I contacted DPS. The short answer is "Not if that's your only certification."

US Public Law 108-277 requires that retired law enforcement officers meet their state's standards for training and qualification for active law enforcement officers. These standards are very different from the standards for CHL licensure.
We cannot assess whether a particular CHL Instructor is qualified to offer such training and to assess the qualifications of law enforcement officers, but such qualification is not related to his or her status as a CHL Instructor.
